These Terms of Service ("Terms") govern your use of the Zerka Blogs application ("the App", "we", "us", "our"), operated by Zerka Limited. By installing or using the App, you ("you", "the merchant") agree to these Terms. If you do not agree, please do not use the App.
Zerka Blogs is a Shopify application that uses artificial intelligence to generate blog posts, images, and social media captions, and to publish them to your Shopify store's blog, either on demand or on an automated schedule you configure. Features and limits are described on the App's billing page and may change over time.
You must have an active Shopify store and the authority to install apps on it. You are responsible for maintaining the security of your Shopify account. The App accesses your store only through Shopify's authenticated session and the permissions you grant at install.
Before first use you must declare where your business is registered and where it operates. The App is not available to businesses registered or operating in certain regions, and we may decline or withdraw access based on your declaration or the location you connect from. You warrant that your declaration is accurate and complete and agree to tell us if it changes.
Paid plans are billed through Shopify's billing system and appear on your Shopify invoice. Pricing, plan limits, and the loyalty discount are described on the billing page and in our FAQ. Cancellation and refunds are governed by our Refund & Cancellation Policy. Fair-use limits apply to all plans to keep the service reliable for everyone.

You must not use the App to generate, schedule, or publish content that is unlawful in any jurisdiction where it will be available, including but not limited to content that:
The App does not verify the legality of any topic in your market. You are responsible for ensuring the subjects you choose to write about, and the content that results, are permitted where you and your customers are located. We reserve the right to suspend or terminate access for misuse.
AI-generated content can contain errors, omissions, outdated information, or statements that are inaccurate or unsuitable for your store. The App generates content programmatically and does not guarantee that any output is accurate, complete, original, non-infringing, or fit for a particular purpose. SEO scores are estimates based on on-page heuristics and are not a guarantee of search rankings, traffic, or sales. You must review and edit content as needed before relying on or publishing it. You retain ownership of the content generated for your store, and you are responsible for how it is used.
The App relies on third-party providers to function, including Shopify (platform and billing), our AI and image-generation providers, our hosting and email infrastructure, and payment processing handled by Shopify. Your use of the App is also subject to those providers' terms, and we are not responsible for their acts, omissions, availability, or changes to their services. Data shared with third parties is described in our Privacy Policy.
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the service will be uninterrupted, secure, or error-free. You use the App and any generated content at your own risk.
To the maximum extent permitted by law, Zerka Limited and the App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, search rankings, or business, arising out of or related to your use of (or inability to use) the App or any AI-generated content, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the App shall not exceed the amount you paid us for the App in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded, including certain rights you may have under consumer laws such as the New Zealand Consumer Guarantees Act.
You agree to indemnify and hold harmless Zerka Limited from any claims, damages, losses, or expenses (including reasonable legal fees) arising from content you generate, schedule, or publish using the App, or from your breach of these Terms or of any applicable law.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, government actions, labour disputes, internet or power outages, or failures, outages, or changes of third-party services (including Shopify, AI providers, or hosting providers).
We may modify, suspend, or discontinue any part of the App at any time. You may stop using the App at any time by uninstalling it, which cancels your subscription and deletes your data as described in our Privacy Policy. We may suspend or terminate access for breach of these Terms.
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. The "Last updated" date above reflects the most recent revision.
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles. You agree to the non-exclusive jurisdiction of the courts of New Zealand for any dispute, subject to any mandatory consumer-protection rights available to you in your own jurisdiction.
